BOC seeks comments on proposed fees order

The Bureau of Customs (BOC) is seeking stakeholders’ comments on a proposed order specifying procedures for collecting dues, fees, and charges for services rendered by customs personnel.

Position papers will be accepted until July 23, the same day for virtual public consultations on the draft customs memorandum order: one in the morning for shipping lines and another in the afternoon for airlines and other sectors.

The draft CMO will implement Customs Administrative Order (CAO) No. 02-2024, which provides BOC’s dues, fees, and charges for services rendered by its personnel.

CAO 02-2024, which took effect on June 10, identifies and provides uniformity in the different fees; collate fees and charges from various BOC memos and orders; and rename a few charges. It also aims to provide a mechanism for the payment of overtime work and other services rendered by BOC personnel.

Customs commissioner Bienvenido Rubio during a Customs Industry Consultative and Advisory Council meeting on July 5 announced the suspension of its implementation following concerns raised by stakeholders, in particular the lack of the corresponding CMO that will implement the CAO.

The draft CMO provides procedure for the billing and/or collection of customs dues, fees, and charges as mandated under CAO 02-2024.

Under the draft CMO, payments will be covered by a billing statement and/or order of payment, unless other forms of notice or order are currently used by BOC such as, among others, the use of BOC Form 51C (official receipt).

The payment should be made either in cash or manager’s check, including other modes of payment, such those integrated in BOC’s Electronic-to-Mobile System or other payment systems implemented by BOC.

Unless already available for the purpose, BOC’s Revenue Collection Monitoring Group (RCMG) will request with the Bureau of the Treasury for trust fund accounts to be assigned to BOC’s 17 collection districts.

The customs service fees for air express cargo operators will be governed by CAO 05-2020, which provides clearance procedures on express shipments, as implemented by CMO 09-2021 due to the special nature of their operations. The exemption from coverage includes aircraft supervision fee, underguarding fee for transfers, off-hours fee, and customs warehouse and facility fee.

The draft CMO covers the procedures in the collection of customs service fees, dues, and charges, and reimbursement of meal, transportation and lodging allowance for customs personnel. – Roumina Pablo
