Cebu Pacific wins Malaysia court case vs MOVE over trademark, ticket sales

A high court in Malaysia stopped online travel agent MOVE Travel Sdn Bhd from using the trademarks and selling the flights of Cebu Pacific and Cebgo in its booking platform.

In a statement on July 7, Cebu Pacific said the High Court of Malaya at Kuala Lumpur held that MOVE is liable for “passing off”, the illegal act of selling a product similar to one that another company has legally protected by a trademark.

MOVE is under MOVE Digital, the digital arm of Malaysia-based Capital A Berhad that operates as AirAsia.

The court granted Cebu Pacific reliefs, including an injunction restraining MOVE from using the two Philippine carriers trademarks. The injunction also stops MOVE from distributing, offering for sale or selling Cebu Pacific flights through its booking platform.

The High Court further ordered MOVE to pay RM120,000 in costs to Cebu Pacific. The High Court also awarded damages to Cebu Pacific, with the payout amount to be assessed in separate proceedings.

In a statement, Cebu Pacific said MOVE “is not entitled to use the CEBU PACIFIC and CEBGO trademarks or to distribute, offer for sale, or sell Cebu Pacific flights bearing those trademarks without Cebu Pacific’s authorization.”

Cebu Pacific in June 2024 commenced legal proceedings against MOVE, saying it never authorized MOVE to use the Cebu Pacific and Cebgo trademarks nor to distribute or sell its flight tickets through the MOVE platform.

Cebu Pacific said it remains supportive of travel platforms and partners that use their trademarks and distribute, offer to sell or sell airline tickets, provided they do so with Cebu Pacific’s proper authorization.

The airline also reminded passengers that booking directly with Cebu Pacific remains the best way to access the airline’s lowest fares and latest promos, manage bookings easily, receive direct flight notifications, and enjoy a smoother customer experience.
